Hacking, Phishing, Scamming and/or any other computer related activities involving illegal data collection and manipulation is not allowed.
Warez, IRC, torrents and trackers, and/or any other sites supporting and promoting distribution of copyright/trademark materials is not allowed.

Any activities deemed illegal in the United States of America or Canada are not allowed. In the case any of the activities takes a place on the TechWest Hosting network and systems, accounts in question will be suspended and TechWest Hosting will report and cooperate with any law-enforcement agency.

TechWest Hosting disclaims any responsibility for any such inappropriate use and any liability to any person or party for any other person or party's violation of this policy.

TechWest Hosting is not responsible for any damages your business may suffer. TechWest Hosting does not make implied or written warranties for any of our services. TechWest Hosting denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by TechWest Hosting.

Network Performance

The TechWest Hosting servers operate in shared environment. Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination of your account.

You are prohibited from excessive consumption of resources, including CPU time, memory, disk I/O, disk space and session time. You may not use resource-intensive programs which negatively impact other customers or the performance of TechWest Hosting servers.

We reserve the right to terminate or limit such activities.

System and Network Security
Users are prohibited from violating or attempting to violate the security of the TechWest Hosting servers. Violations of system or network security may result in civil or criminal liability.

TechWest Hosting will investigate occurrences, which may involve such violations and may involve, and cooperate with law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, without limitation: Accessing data not intended for such User or logging into a server or account, which such User is not authorized to access.

Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization. Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing".

Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Taking any action in order to obtain services to which such User is not entitled.

Data Backup and Storage
Although we may provide data backups, TechWest Hosting is NOT responsible for any customer files residing on TechWest Hosting equipment or off site data backup equipment.

You, the customer, are responsible for independent backup of your data that is stored on TechWest Hosting equipment.

TechWest Hosting reserves the right to delete any customer files after either one or both parties terminates the service agreement.

Payments, 60 Day Money Back Guarantee and Chargebacks
60 Day Money Back Guarantee only applies to hosting services and excludes all add-on extras such as dedicated IP, domain registration fees, SSL Certifcates. Payments are made for 30 days in advance and will be charged automatically via 2Checkout or Paypal every 30 days unless you sign up for multi-month plan.

If you need to cancel your account within first 60 days of sign-up date, we will refund you hosting fees within 5 business days. After the first 60 days if cancellation is made you will be refunded for the remainder of the current prepaid period, or for the multi-month accounts refund will be made for the reminder of the term.

Please note 60 day money back guarantee does not apply to the domain registration. Fees of $9.95 for domain registration are not refundable at any time. If you request refund during the first 60 days $9.95 will be deducted from the total payment.

Charge backs or disputes of any kind will result in an immediate termination of all services on your account, whether you charged back one or all items on your account.

Acceptable Use Policy
Under no circumstances will the action of EMAIL SPAMMING be tolerated. You are expressly prohibited from sending unsolicited bulk mail messages ("junk mail" or "spam"). This includes, but is not limited to, bulk-mailing of commercial advertising, information announcements, and political tracts. Such material may only be sent to those who have specifically requested it.

Malicious or threatening email is also prohibited. Violators will have all services immediately terminated and no refunds will be issued. To report this type of violation please forward email with full headers to support@techwesthosting.com.

If your site results in our IP Space being blacklisted, we will immediately terminate your account and send to collection an administrative fee of $500(USD). All content that you upload to this server will be considered to be your own intellectual property. TechWest Hosting will hold no copyright claims to your electronic files.

Your site content/files may not exceed the quota of your hosting plan. If you exceed your monthly bandwidth quota, you will be notified and billed for each gigabyte of bandwidth of overuse at the rate of $1.50 per gigabyte over your quota. You will have until the last day of the calendar month to reduce your usage OR upgrade to a hosting plan suitable to your needs. If you do not reduce your usage or upgrade your hosting plan, TechWest Hosting reserves the right to suspended your services on the last day of the calendar month without refund.

TechWest Hosting will not be responsible for moving, reconfiguring or updating files that need to be moved to an upgraded server for this reason. You may not post, publish, illustrate or upload any material that violates or infringes on the copyright, intellectual property rights or trademark rights of any individual or organization. This includes, but is not limited to, all sound and video files/formats, images, and text media. This also applies to linking directly to illegal files or other sites that offer any illegal material.

You may not post, publish, illustrate or upload any material that is grossly offensive to the general on-line community, including but not limited to, exploitation of children, blatant expressions of bigotry, hatred, harassment, defamation, invasion of privacy. This includes material that defames, abuses, harasses or threatens any person or group.

Shared Hosting Clients
Streaming Video and Audio: Streaming Video and Audio is not permitted on our servers. You must zip the content to prevent this if you wish to have it hosted, and as everything else this content must be legal content and can not have someone else's copyright.

Egg Drop

Egg Drop Scripts are not allowed!

These are grounds for immediate account deletion without a refund.

IRC

IRC Client or Server in any form is not permitted on our servers. Basically IRC in any form is not permitted.

Legal

If it is not legal in the United States of America or Canada, it is not permitted to reside on our server. If site is found to be violating it will be terminated.

Hosting of warez content, torrents, MP3's and using our hosting service as a remote backup is not allowed!

Legal Adult Material

Adult Content is NOT allowed on any server.

TechWest Hosting reserves the right to remove or deactivate without notice any type of script or programming that violates these terms of service or interferes with the operation of your web server. Repeated offences will cause termination of services.

Privacy Policy

This privacy notice applies to all information collected and/or submitted on any of the TechWest Hosting websites. On some pages, you can order services and to fulfill the order we ask some personal information. The types of personal information collected at these pages are: Full Name, Address, Phone Number, E-mail Address(s), username, password, domain, IP Address.

TechWest Hosting uses the information you provide about yourself when placing an order only to complete that order.

We do NOT share this information with outside parties except to the extent necessary to complete that order, such as for domain registrations.

Miscellaneous
TechWest Hosting reserves the right to remove material(s) from the server(s) that are in violation of these terms and discontinue service to any person(s) in violation of these terms.

You are solely and fully responsible for the contents of your web space and backing up those contents on a regular basis. Any and all repercussions will be born solely by you as the account holder. TechWest Hosting will not be held responsible or accountable for any materials published, stored or otherwise held in your web folder.

TechWest Hosting makes no guarantee of availability of service and reserves the right to change, withdraw, suspend, or discontinue any functionality or feature of the hosting service.

TechWest Hosting will not be held liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use TechWest Hosting service(s) or any content thereon.

This disclaimer applies, without limitation, to any damages or injury, whether for breach of contract, tort, or otherwise, caused by any failure of performance; error; omission; interruption; deletion; defect; delay in operation or transmission; computer virus; file corruption; communication line failure; network or system outage; or theft, destruction, unauthorized access to, alteration of, or use of any record.

TechWest Hosting reserves the right to change or amend these Terms Of Service, Acceptable Use Policy at any time and without prior notice. It is your responsibility to be familiar with these Guidelines in the event that they change at any future time.

Either party may terminate or cancel hosting at any time by providing written 5 day notice to or from the domain registrant and/or the responsible billing party.
